Please read the Termsand Conditions carefully before using the Website and placing your order. By accessing any part of the Website or ordering goods from the Website,you agree that you have read the Terms and Conditions and that you agree and acceptto be bound by the Terms and Conditions.
1. Eligibility toPurchase
It is illegal to sellalcohol to any person under the age of 18. By placing an order, youundertake and warrant that:
a. you are 18 yearsold or above and are entitled to purchase alcohol products legally;
b. no other personexcept you shall use your Account (as defined below) to purchase any alcoholproducts;
c. a person aged 18 orabove must be present to receive delivery; and
d. all informationprovided by you to us are true, accurate and up-to-date in all respects and atall times.
Otherwise, orderand/or delivery service shall be withdrawn and/or attempted at another time tobe agreed by you and us.
2. Registration
2.1 You are requiredto create an account by registering for a membership (the “Account”) in orderto use the services, including placing order, made available to you onthe Website (the “Services”).
2.2 During theregistration, you are required to provide us with true, accurate, complete andup-to-date information.
2.3 If there is anychange of your information, you are required to inform us in a timelymanner. Otherwise, provision of the Services by us may be affected.
2.4 You are requiredto maintain the confidentiality of your Account, username and password. You may not authorize any other person to use your Account, username andpassword.
2.5 We may refuse toapprove any registration and terminate any membership at our sole discretionwithout giving any reason.
3. Descriptions andPricing of the Goods
3.1 We shall endeavourto ensure that contents, descriptions and prices of the goods on the Websiteare as accurate, complete and up-to-date as possible. However, we do notwarrant that any such contents, descriptions and prices of the goods are accurate,complete, updated and error-free.
3.2 We shall endeavourto ensure that the goods displayed at the Website are in stock. However,we do not warrant that all of the goods are available at the time you place theorder.
4. Availability andNon-Exploitation
4.1 All orders aresubject to confirmation of final availability. If any of the goodsrequested are unavailable, we shall have the right to remove the unavailablegoods from the order or reject the order. Payment made for unavailablegoods will be refunded to you within 4-6 weeks.
4.2 The goodspurchased on the Website are for your personal use or gift only and are not tobe used for re-sell or commercial purposes. If we have a ground tobelieve that you are NOT purchasing our goods as an end user, we shall have theright to decline or cancel your order.
5. Order Acceptance
5.1 Your orderconstitutes an offer to us to purchase the goods you select from theWebsite. Upon receipt of your order, we will send you an email/ messageto the email address/ mobile number provided by you to us for confirmingreceipt of your order (the “Order Confirmation”). However, the OrderConfirmation does not constitute an acceptance of your order.
5.2 All orders aresubject to confirmation of final availability and will not constitute a bindingcontract of sale until accepted by us. We reserve the right to rejectyour order for any reason at our sole discretion.
5.3 Once your order isaccepted, we will send you a second email/ message with a summary of details ofyour order (the “Delivery Confirmation”) to the email address/ mobile numberprovided by you to us. The Delivery Confirmation shall constitute ouracceptance of your order and a binding contract of sale shall be concludedbetween you and us.
5.4 In the event thatthe goods ordered by you are not be available at the time you place yourorder. Our acceptance of your order shall be limited to the goods thatare available. No contract of sale will be concluded in respect of thegoods that are unavailable.
6. Payment
6.1 All prices arelisted in Hong Kong Dollars.
6.2 The applicableprices shall be the prices listed on the Website as at the date of purchaseexcept any obvious error. We shall have the right to cancel any order forthe goods which have been listed with such obvious error.
6.3 We accept paymentby electronic means as specified by us and bank transfer.
6.4 All transactionsconducted by or with us are made in Hong Kong Dollars. If your creditcard account is not denominated in Hong Kong Dollars, the final price to becharged in your currency will be converted at the exchange rate determined byyour credit card issuing bank in accordance with the applicable exchange rateon the day your credit card issuing bank processes the transaction.
7. Title and Risk ofLoss
Title to the goodsshall remain vested in us until we receive full payment of the price. Risk of the goods shall pass to you immediately upon our delivery of the goods.
8. Delivery Service
8.1 You may enjoy afree local delivery service to your designated address for a single order uponany purchase of goods on the Website with a net transaction value of HK$2,000or more. For order less than HK$2,000, a delivery charge of HK$200 shallapply.
8.2 You are requiredto provide us with an accurate and valid email address, phone number andaddress for delivery. We shall not be liable for any responsibility inthe event that the goods could not be delivered to you due to an error of anyof the said contact details.
8.3 Delivery serviceis only available at commercial or residential addresses located in Hong KongIsland, Kowloon, New Territories and Tung Chung.
8.4 Delivery serviceis not available:
a. at non-permanentaddress, outlaying islands, restricted areas, ports, marinas, hotel guestrooms;
b. at premises abovefourth floor of a building which are not accessible by elevator; and
c. where there are noauthorized or legitimate unloading area within 50 meters of the building of thedelivery address
8.5 We shall dispatchall the goods ordered by you as soon as possible after your order has beenaccepted by us. We will provide you with an indication of the estimateddelivery date and time in the Delivery Confirmation. We will try our bestto meet the estimated delivery but we cannot guarantee that such estimate canbe met. We shall not be liable for any loss or damage incurred orsuffered by you due to any late delivery.
8.6 When you receivedthe goods, you are required to sign a confirmation of receipt of the goodsordered by you for confirming your acceptance of the goods (the “Confirmationof Receipt”).
Please checkcarefully the quantity and quality of your goods before you sign off theConfirmation of Receipt. If you find the goods are not in compliance with yourorder as listed in , you may refuse to accept such items.
8.7 Any acceptance ofdelivery shall mean the delivery is complete and correct and no respectiveclaims shall be made.
8.8 If the recipientis not you, or in case of delivery of a gift, then you accept the recipient’ssignature is evidence of delivery and fulfilment of your order by us.
8.9 If you fail toreceive the goods ordered by you on the delivery date and time as confirmed, weshall have the right to charge you an additional delivery fee for subsequentdelivery.
8.10 Delivery servicewill be suspended when typhoon signal No. 8 or above or black rain storm signalis hoisted. We will notify you as soon as possible with the re-scheduleddelivery date and time of your order.
9. Exchange and Refund
9.1 We do not acceptany request for cancellation of order, exchange and/or refund of goods unlessthe goods (i.e. bottle) is damaged or the goods delivered to you is notcompliance with details of your order as listed in Delivery Confirmation.
9.2 In such case,please contact us to make exchange arrangements within three (3) days upondelivery. Exchange request after three (3) days will not beaccepted. Please note: Original sales receipt must be produced to us foryour request of exchange of goods.
9.3 If we agree youare entitled to an exchange but the goods to be exchanged is/are sold out, youmay return such goods to us and apply the amount of the returned goods paid byyou to purchase alternative goods.
9.4 All gift must bereturned together with the returned goods.
10. Undelivered Goods
For any ordered goodsremain undelivered for six (6) months from the issuance date of DeliveryConfirmation, we shall have the right to dispose of such goods at our solediscretion without further notice to you. In such event, we shall not beliable to make any refund or compensation to you.
11. Liabilities
We shall under nocircumstance be liable for any loss, whether direct and indirect, of revenue,loss of profits and/or consequential loss whatsoever suffered, sustained orincurred by you by or other person arising directly or indirectly out of thesale and purchase transaction with you.
12. Force Majeure
We shall not be liablefor any delay or failure to meet any of our obligations which is caused by orresult from factors or circumstances beyond our reasonable control, includingbut not limited to adverse weather, fire, flood, pandemic, accident, riot, war,labour disputes, strikes, embargo, government interruption or failure oftransportation, etc.
13. Interpretation
We shall have theright to interpret the Terms and Conditions. In case of any disputes, ourdecision shall be final and binding on all parties concerned.
14. Governing Law andJurisdiction
The Terms andConditions shall be governed by and construed in accordance with the laws ofHong Kong Special Administrative Region (“Hong Kong”). Any disputes thatmay arise shall be subject to the non-exclusive jurisdiction of the courts inHong Kong.
15. Privacy
We commits tosafeguard the privacy of your personal data. We therefore make sure thatour policies and practices in relation to the collection, process, use, access,retention and transfer of your personal data in compliance with therequirements of the Person Data (Privacy) Ordinance (Chapter 486) under thelaws of Hong Kong. 16. Miscellaneous
16.1 We shall have theright to change and update the Terms and Conditions at any time without priornotice. You are advised to check back from time to time for any changesor updates to the Terms and Conditions.
16.2 If any provisionof the Terms and Conditions shall be construed to be illegal or invalid, suchprovision shall be removed from the Terms and Conditions and it shall notaffect the legality, validity and enforceability of the other provision of theTerms and Conditions.
16.3 The Chineseversion of the Terms and Conditions is for reference only. In case of anydiscrepancies between the Chinese version and the English version, the Englishversion shall prevail.
